Whistleblowing, Ethics and Protected Disclosures

Most serious fraud is reported by a colleague, not found by an auditor. Building a reporting channel people actually trust means understanding what the Protected Disclosures Act 26 of 2000 protects, how occupational detriment is proved, and how to triage and close a disclosure without exposing the person who made it.

What you will be able to do

  • Explain which disclosures qualify for protection under the Protected Disclosures Act 26 of 2000 and to whom they may be made.
  • Identify occupational detriment and the employer conduct that gives rise to it.
  • Design a reporting channel with anonymous and named options and a published response standard.
  • Triage incoming disclosures by seriousness, credibility and required investigative skill.
  • Protect the identity of a discloser through the investigation, hearing and record keeping stages.
  • Report on disclosure volumes and outcomes to the audit committee without revealing identities.
