Municipal By-Law Drafting and Enforcement Administration

This course equips municipal officials to draft enforceable by-laws and to administer a credible enforcement regime once they are promulgated. Participants work through the drafting, public participation and gazetting process, then examine how to operationalise by-laws through notices, fines and municipal courts. The programme responds to the reality that many African municipalities have outdated or unenforceable by-laws that undermine service delivery and public order.

What you will be able to do

  • Identify the by-laws a municipality needs and the powers underpinning them.
  • Draft clear, enforceable by-law provisions with workable offence clauses.
  • Follow the public participation and promulgation process correctly.
  • Establish enforcement procedures using notices, fines and compliance orders.
  • Coordinate enforcement with peace officers, courts and other departments.
  • Monitor enforcement outcomes and revise by-laws that are not working.
