Chairing Disciplinary and Incapacity Enquiries

The person chairing a hearing decides whether a dismissal survives scrutiny. This practical programme trains delegates to chair disciplinary and incapacity enquiries fairly and defensibly, weighing evidence, applying the right procedure and recording sound findings. Delegates work through realistic African workplace cases and practise chairing mock enquiries with feedback on procedural and substantive fairness.

What you will be able to do

  • Distinguish misconduct, poor performance and incapacity matters.
  • Apply the principles of procedural and substantive fairness.
  • Chair an enquiry impartially and control the proceedings.
  • Weigh evidence and assess the credibility of witnesses.
  • Reach and record defensible findings and sanctions.
  • Avoid the common errors that lead to unfair dismissal rulings.
